It is a truth universally acknowledged, that a single man in possession of a good fortune, must be in want of a wife.
Viewed through the prism of the estate and trust law of Regency England, perhaps the line should read: It is a truth universally acknowledged, that a typical Austen heroine must be in need of a husband with a good fortune. The law would certainly leave her out in the cold otherwise. All of Jane Austen’s six novels have characters who struggle in one way or another with the impact of distribution of property on women and, to a lesser extent, on men. In Austen’s England women had little or no ability to make an enforceable contract, execute a valid will, secure child custody, or own property outright. Jane Austen plainly presented this harsh reality, but she tempered it with a happy ending.

JASNA MD member Karen Stakem Hornig is the Deputy Commissioner of the Maryland Insurance Administration. She and her husband, Craig J. Hornig, wrote an article entitled "Austen on Estates and Trusts" for the Maryland Bar Journal published in January 2010.
